1. The Financial Conduct Authority (FCA)

The FCA is the independent watchdog that regulates financial services. This document is designed by the FCA to be given to consumers considering buying certain financial products.

You need to read this important document. It explains the service you are being offered and how you will pay for it.

2. Which service will we provide you with?

Independent advice – We will advise and make a recommendation for you after we have assessed your needs. Our recommendation will be based on a comprehensive and fair analysis of the market.
Restricted advice – We will advise and make a recommendation for you after we have assessed your needs, but we only offer advice on limited types of products, or products from one company or a limited number of companies.
No advice – You will not receive advice or a recommendation from us. We may ask some questions to narrow down the selection of products that we will provide details on. You will then need to make your own choice about how to proceed.

 

We offer a non-advised service in relation to Lifetime Annuities offered from the following limited companies:

Aviva, Canada Life, Hodge Lifetime, Just Retirement Limited, Retirement Advantage and Scottish Widows.

3. What will you have to pay us for our services?

If you buy a Lifetime Annuity, we will normally receive commission on the sale from the product provider. Although you pay nothing up front, that does not mean our service is free. You still pay us indirectly through product charges. Product charges pay for the product provider’s own costs and any commission. These charges reduce the amount left for investment. If you buy direct, the product charges could be the same as when buying through an adviser, or they could be higher or lower.

We will tell you how much the commission will be before you complete an investment, but you may ask for this information earlier.


4. Who regulates us?

Just Retirement Solutions Limited’s parent company is Just Retirement (Holdings) Limited, a UK registered company.  Just Retirement (Holdings) Limited also owns Just Retirement Limited.

7. Are we covered by the Financial Services Compensation Scheme (FSCS)?


We are covered by the FSCS.  You may be entitled to compensation from the scheme if we cannot meet our obligations.  This depends on the type of business and the circumstances of the claim.
Most types of investment business are covered up to a maximum limit of £50,000.

Terms of business


Services

1 Just Retirement Solutions Limited (also referred to in this section as “we”, “us”, or “our”) is authorised and regulated by the Financial Conduct Authority (“FCA”).  We act in accordance with FCA rules and guidance.

2 The scope of our services is limited to the provision of information in relation to the purchase of an Lifetime Annuity (as used in section 2 above of the ‘Key facts’ document).  An annuity is a contract sold by an insurance company designed to provide the holder with an income at regular intervals, usually after retirement. A Lifetime Annuity is an annuity that provides benefits during a person’s lifetime, which cease at their death.    It is your responsibility to decide on the terms of the annuity for example, with regard to the rate of increase, the provision made for dependants and whether payments are guaranteed or not. We offer a range of annuities from the product providers listed in section 2 above of the ‘key facts’ document.
We facilitate the process of effecting these arrangements for you and will not provide any advice on which Lifetime Annuity is best suited to you.  You are responsible for ensuring that the Lifetime Annuity chosen is best suited to your needs.  We give you no warranty as to the suitability of the Lifetime Annuities quotes obtained as part of this document and assume no fiduciary duty in our relations with you.

3 These terms come into effect when you first make contact with us or are contacted by Just Retirement Solutions Limited.

4 We will accept your instruction orally or in writing.  We will acknowledge, either in writing or orally, any instruction you give us.  We can refuse your instructions at our discretion.

5 Please be aware that telephone calls to our office are recorded and monitored.

6 We will forward to you all documentation that we receive about Lifetime Annuity products.

Client categorisation

7 We classify all customers as ‘retail’ customers.  This means that you have rights with the Financial Ombudsman Service and Financial Services Compensation Scheme (FSCS).  Further details are shown in Sections 6 and 7 above of the ‘Key facts’ document. 

8 The products in respect of which we offer an non-advised service are covered (via the relevant product provider firms) with the FSCS (as detailed above in section 7 above of the ‘Key facts’ document).

9 Our fees and charges are detailed above in section 3 above of the ‘Key facts’ document.

Conflicts of interest

 

We offer advice to you in accordance with the information set out in the ‘Key facts’ document. There may be occasions where a potential conflict of interest may arise in the business that we are transacting for you. If this happens, we will write to you providing full details before we carry out your instructions.

Money laundering and financial crime

11 All transactions relating to the Services provided by us are covered by Money Laundering Regulations 2007, the Proceeds of Crimes Act 2002 (as amended), the Terrorism Act 2000 and the Anti-terrorism, Crime and Security Act 2001.  The FCA also requires that we have appropriate measures in place to prevent the furtherance of financial crime.  Our responsibilities under these laws and regulations, and the rules of the FCA, include but are not limited to verifying the identity and address of our clients and of any third party making payments on their behalf.  Where we require, you must supply proof of your identity in accordance with the requirements of the above regulations.  Such verification may include electronic searches of the electoral roll and the use of credit reference agencies, which will result in a ‘soft foot-print’ on your credit records.  The footprint is not visible to other financial service providers and does not affect your credit rating in any way. 

Client money

12 We do not handle client money.  Therefore, we will never accept cash and will not accept a cheque made out to us.

Data protection

13 For the purposes of this clause the terms “processing”, “process”, “sensitive personal data” and “personal data” shall have the meanings given to them in the Data Protection Act (“DPA”).

14 We shall ensure that all personal data is collected and used fairly and lawfully and shall ensure that the DPA is complied with at all times.

15 By signing the Customer or Power of Attorney declaration below you consent to us processing your personal data (including sensitive personal data) for the purposes set out in the section below titled “Use of information and the Data Protection Act 1998”.

Insurance

16 Just Retirement Solutions Limited carries professional indemnity insurance.

Cancellation / termination of services

17 You or we may terminate our authority to act on your behalf at any time, without penalty.  Notice of this termination can be given orally by you or by either you or us in writing and will take effect from the date of receipt.  Notice to terminate in writing should be provided to the address given in section 6 of the ‘Key facts’ document.  Termination is without prejudice to any services already provided / transactions already initiated, which will be completed according to this ‘Key facts’ document unless otherwise agreed in writing.

Right to withdraw

18 Where you select a Lifetime Annuity on which you have a right to cancel, we will notify you of this right in writing.

Other important information

19 Each of the clauses of these Terms of Business operates separately.  If any court or relevant authority decides that any part of any clause is (i) unlawful, the remaining parts of that clause and all other clauses will remain in full force and effect; (ii) unfair it will, as far as possible, still apply but without any part which could cause it to be held, viewed or considered unfair.

20 If we fail to insist that you perform any of the obligations under these Terms of Business, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.  If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

21 We are not liable or responsible for any failure to perform, or delay in the performance of, any of our obligations under these Terms of Business that is caused by an event outside our control.  Such failure or delay does not amount to a breach of our obligations under these Terms of Business.  An "event outside our control" means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.  In these circumstances, we must contact you as soon as reasonably possible and the time for performance of our obligations will be extended accordingly.

22 We are not liable or responsible for any mistakes in the services we provide under these Terms of Business resulting from any information we receive in connection with the service being incorrect, or relevant information not being provided.

Governing law and jurisdiction

23 These Terms of Business will be governed by and construed in accordance with English law and you and we both agree to submit to the non-exclusive jurisdiction of the English courts as regards any claim or matter arising under these Terms of Business.

 

Use of information and the Data Protection Act 1998

Just Retirement Solutions Limited may provide you with general information on Lifetime Annuities.

We need to collect information about you to assist you to select the most suitable Lifetime Annuity based on your circumstances, requirements and for certain other specified purposes. This section tells you why we ask for information, who we provide it to, the purposes for which it may be used and explains how we will protect your privacy.

Compliance with data protection law

We are conscious of our responsibilities under the DPA and will ensure that the information you provide to us will always be processed and transferred in compliance with all applicable data protection laws and regulations.

What information we may obtain

We may obtain a variety of information about you that may include (but is not limited to) information relating to your financial circumstances (for example, your income, outgoings and existing investments), gender, dependants, together with information about your aims and aspirations. We may also ask you about sensitive personal data such as your physical and mental health.

Any information that is received about you may be retained for at least 6 years.

Your rights

The DPA gives you the right to see any personal data that we hold about you. We may charge you a small fee for providing this information but it will not exceed any prescribed statutory limit.
You have the right to require any inaccuracies in personal data relating to you to be corrected.
You have the right to prevent processing of personal data (including sensitive personal data) for the purposes of direct marketing.

Sharing and use of your information

We will only use the personal information you provide to us for the following purposes:

a) in order to provide the above mentioned services to you;
b) for the administration and continuing review of your Lifetime Annuity
c) to contact you either by telephone or by email about the services you received from us;
d) to comply with legal and regulatory obligations;
e) to perform credit checks and verify your identity;
f) for general administrative purposes, including the storage and backup of data;
g) for business and analysis purposes;
h) for the prevention and detection of fraud.

We may share personal information that you provide or make available to us with: our group companies (for purpose i to iii below), any product providers (for the purpose of iv below), and to Moneyfacts.co.uk Limited (for purposes i, ii, iii,  and v) for the following purposes:


i. comply with legal and regulatory obligations;
ii. for general administrative purposes, including the storage and backup of data;
iii. for business and analysis purposes;
iv. for the purposes of obtaining quotes from product providers and reports for you
v. to provide you with information about other products and services from Moneyfacts.co.uk Limited or any of its group companies that may be of interest.

The product providers that we share your personal information with, may also use your personal information (either alone or in conjunction with a third party) and may also pass your personal information to their group companies for the following purposes:

• for market research and statistical purposes;
• for gauging sales or product performance;
• for the prevention and detection of fraud;

The product providers may also pass your personal information to their third party reinsurers to enable them to provide you with a quote.

Transmission of personal information

Data that you provide or make available to us may be transferred to product providers who may transfer such data to countries outside the European Economic Area ("EEA") that may not have equivalent laws and rules to protect personal information as the United Kingdom. By way of example, we transfer the information provided to product providers who may process your personal information outside of the EEA for general administrative purposes, including the storage and backup of data and in order to provide you with a quote. These companies are required to process personal information about you in accordance with the DPA.
